TICKET PURCHASING TERMS & CONDITIONS
- General Terms
1.1. Ticket prices shown are for events happening in the Republic of South Africa only and are stated in South African Rand (ZAR).
1.2. We act as an agent on behalf of promoters, teams, bands and venue providers, and organizers of events (“Event Organisers”). We sell tickets to you and collect payment from you on behalf of these Event Organisers. Every ticket that you purchase from us is subject to our T’s & C’s, as well as the Event Organiser’s terms that apply to that particular event (“Ticket Terms”). Some of the Ticket Terms may be set out on your issued ticket or will provide you with a link to our website where these terms are stored. Each ticket you buy from us relate to a specific event only and you will not be able to attend any other event with the same ticket.
1.3. Any rights you may have in terms of the ticket(s) you purchase, can only be enforced against the Event Organiser. It is your own responsibility to make sure that you understand the terms and conditions that apply to the event you are booking for, before you pay for the tickets. We, the venue and the Event Organiser will have no further liability beyond the face value of the ticket(s) purchased, plus the relevant per ticket booking fee.
- Booking your tickets
2.1. When you book and pay for your tickets, you have to complete the entire boking form and provide all the information requested. You have to be at least 18 years old to book any tickets on our site, otherwise you cannot consent to the terms and conditions and you will need your parent or legal guardian to book the tickets on your behalf.
2.2. We will ask you to complete our automated ticket booking process and to submit your payment information to us. We will always give you a chance to review the whole transaction, to help you correct any mistakes you could have made or to cancel everything, before you submit your booking request.
2.3. Once you have submitted your booking request (which includes the payment information), the details you included will be final and it is not possible to rectify any mistakes you may have made. You will be responsible for the payment of any such tickets booked, even if they contain mistakes you made.
3.1. You must provide the specific payment account details (such as credit card details) when submitting your booking request. By submitting a booking request to us, you authorise us to debit your designated account with the relevant amounts due for the tickets ordered. This authorisation will allow us to obtain payment at any time after our confirmation of your booking.
3.2. We will not issue any ticket(s) to you prior to receiving full payment of the full agreed amount payable in respect of such ticket(s). Should we be unable to duly effect such payment for any reason whatsoever, your booking may be cancelled and your ticket(s) may be resold to another customer without further notice to you. You warrant that you are duly authorised to make payments from the account designated by you. You also authorise us to pay all amounts to be refunded to you into the account details you provided to us.
3.3. Following receipt of your valid booking request and payment, we will send you a confirmation e-mail (to the email address you provided), confirming your booking and containing your
electronic ticket(s), containing unique identification numbers, barcodes and/or access codes. You are responsible for keeping such identification numbers, barcodes and/or access codes secure since such identification numbers, barcodes and/or access codes will enable the first user thereof to access to the relevant event and only a single use thereof will be permitted.
3.4. Please note – while we will try to send you a confirmation notice for every valid booking request we receive from you, we cannot guarantee that such confirmation notice will be received by you, or that the confirmation and electronic ticket(s) sent to you will be legible and uncorrupted.
3.5. If you do not receive a confirmation email and electronic ticket(s) after submitting your payment information, or if you experience an error message or service interruption after submitting your payment information, you must confirm with us whether or not your order has been received and processed. You are the only one that may be aware of any problems that occurred during the booking process. We will not be liable for any losses you may experience because you assumed that a booking was not processed, because you did not receive a confirmation notice and ticket(s) via e-mail.
- Details of Events & Ticket Prices
4.1. Although we always try to ensure that all prices on our site are accurate and up to date, errors may occur. If we discover an error in the price of tickets you have booked, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price (and credit or debit your account as applicable) or cancelling your order. If we are unable to contact you, you agree that we may treat the order as cancelled. If you choose to cancel after you have already paid the incorrect ticket price for the tickets, you will receive a full refund from us.
4.2. The details of the events (including the Event Organiser, venues and seating arrangements) for which tickets are offered are set out on our website ww.ticketgenie.co.za and are provided to us by the relevant Event Organisers.
4.3. We do not:
4.3.1.Endorse any of the events we present for booking on our site;
4.3.2.Determine or control the number of tickets available, the prices of tickets or the chosen venues relating to any event and we do not accept any responsibility for inaccuracies, unavailability of tickets or changes in venues or pricing that may occur.
4.4. If you are dissatisfied with an event or the venue where an event took place, the seating arrangements, the suitability of the performance, the security at the event or anything similar, please contact the relevant Event Organiser – we cannot assist herewith.
- Changes to or cancellation of events
5.1. It is your responsibility to check whether an event has been cancelled and the date and time of any rearranged event. If an event is cancelled or rescheduled, we will use reasonable endeavours to notify all holders of ticket(s) of the cancellation (once we have received the go ahead from the relevant Event Organiser). We do not guarantee that ticket holders will be informed of such cancellation in time and before the date of the event.
- Resale of Ticket(s)
6.1. You may not resell or attempt to resell any ticket(s) purchased from us – this is strictly prohibited. Any such resale or attempted resale of ticket(s) purchased from us will immediately entitle us to cancel such tickets and to resell them to our other customers. You may also not use any ticket(s) purchased from us for advertising, promotion or competition purposes unless you have not first obtained formal written authorisation from us to do so. Even if you have obtained such written consent, you may still only use any of our logos or trademarks if we have expressly authorised this in writing.
- Personal Information
7.1. We are committed to protecting your privacy and your personal information. We will collate the personal information you give us during the booking process to provide you with services and personalise your use and visits of this site. We may also use such information to inform you,the registered user of our site, about changes in the services we offer and/or about features we think you would find of interest.
7.2. We may use the personal information you provide during the booking process for the purposes of executing transactions concluded with you, for customer services and client administration, through both email and SMS channels.
7.3. We will not send you any unwelcome information or provide your information to third parties. We will only send you details of similar events or events that might interest you, if you have specifically confirmed that you want such information to be sent to you.

- Housekeeping clauses
9.1. You consent that the use of our digital system and services are subject to the laws of the Republic of South Africa and subject to the jurisdiction of any South African Magistrate’s Court of competent jurisdiction in respect of your person to adjudicate on any dispute arising from or in connection with these terms, even if the amount in dispute may exceed such court’s jurisdiction. You also agree to accept service of any legal process at the addresses you may provide to us.
9.2. These terms and conditions comprise the entire agreement between you and us with respect to your use of our digital systems, the services offered and any ticket(s) acquired through our digital system.
9.3. If we decide not to enforce any provision of these terms and conditions strictly, it will not be construed as a waiver of any provision or right.
9.4. Every clause of these terms and conditions are severable from the others. This means that if any one or more of the terms are invalid, the rest of the terms remain valid.
9.5. We will not be legally responsible to you for any loss, costs, expenses, damages, or any claims, lawsuits, demands, of any kind whatsoever, because of any service
interruptions or if there is a failure in the performance of our obligations as a result of
circumstances that were beyond our reasonable control.
9.6. Attending any event may be hazardous to the health or safety of the attendees or their property. You attend any event at your own risk and we are not responsible for the safety or security arrangements at any event. Please contact the relevant Event Organiser if you have suffered any loss or damage while attending an event.
- Warranties and Liability
10.1. ALTHOUGH WE TRY TO MAKE SURE THAT THE DETAILS OF THE EVENTS THAT APPEAR ON OUR DIGITAL SYSTEM ARE COMPREHENSIVE AND ACCURATE, WE DO NOT WARRANT THIS AND DISCLAIM TO THE MAXIMUM EXTENT PERMITTED BY LAW ANY LIABILITY ARISING FROM ANY OMISSIONS AND INACCURACIES PERTAINING TO SUCH DISPLAY OF THE DETAILS, SAVE TO THE EXTENT THAT SUCH LIABILITY IS CAUSED BY OUR GROSS NEGLIGENCE OR FRAUD.
10.2. WE WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL LOSSES OF ANY KIND WHATSOEVER ARISING IN CONNECTION WITH ANY BOOKING (WHETHER IN CONTRACT, STATUTE OR DELICT, INCLUDING FOR NEGLIGENCE), SAVE TO THE EXTENT THAT SUCH LIABILITY CANNOT BE EXCLUDED BY LAW.
10.3. IN NO EVENT WILL OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING IN CONNECTION WITH ANY BOOKING EXCEED THE TICKET PRICE ACTUALLY RECEIVED FROM YOU IN RESPECT OF SUCH BOOKING – IRRESPECTIVE OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, STATUTE OR DELICT, INCLUDING FOR NEGLIGENCE), SAVE TO THE EXTENT THAT SUCH LIABILITY CANNOT BE EXCLUDED BY LAW.
